Privacy Notice

I.- Personal information will only be collected under the following assumptions: a. negotiations; b. personnel recruitment; c. supplier registration; d. personnel administration; e. IT systems development; f. personnel training; g. internal personnel information management; h. external personnel information management; i. prospective employee information for GTIM SOFTWARE PROJECTS, S. DE R.L. DE C.V. (hereinafter “GTIM”); j. internal audit information; k. external audit information; l. information to provide to clients and suppliers about assigned resources.
The management of the collected personal information is the responsibility of GTIM, with address at Humberto Junco Voigt 2307 Torre I Piso 2 Col. Valle Oriente San, 66290 San Pedro Garza García, N.L., Mexico.

II.- The user, at the moment of filling out the forms, gives their consent for GTIM to use their information for the purposes stated below: internal analysis of GTIM, in order to contact individuals who enter their personal data for possible job vacancies at GTIM, and/or clients and/or prospective clients it may have, as well as to send merchandise, correspondence, purchase orders, tax receipts and all documentation or information related to the commercial and/or labor activity carried out with the data provider for internal control of our clients. The fact that information is entered by this means, in no way implies an agreement, communication, hiring, consideration for a specific position, nor does it generate any obligation for GTIM or its affiliated companies, except for the legal provisions regarding personal data protection.

III.- The personal data entered on this page will be protected with the same security procedures used to protect GTIM’s own data within its IT platforms and will only be used by authorized personnel who have current CONFIDENTIALITY agreements with GTIM and with the owners of the personal information.

IV.- The Data Subjects will have the right to request access, rectification, cancellation, or opposition of their data (ARCO rights), by written request addressed generically to GTIM SOFTWARE PROJECTS, S. Or by means of the following form [ARCO Rights Form] which can be filled out electronically.

V.- The information entered by the user will not be disclosed under any circumstances, except with the authorization of the person who owns it, with the exception of what is provided in current and applicable National Laws and International Treaties.

VI.- “Sensitive information” is understood, in accordance with Article 3, Section VII of the Federal Law on Protection of Personal Data Held by Private Parties, as follows: Racial or ethnic origin, present and future health status, genetic information, religious, philosophical, and moral beliefs, union affiliation, political opinions, and sexual preferences. Due to the foregoing, GTIM will also not create databases containing this type of information.
GTIM will not, under any circumstances, request “sensitive information” from the users of this website, therefore, they must refrain from entering it in the fields provided for that purpose. Any “sensitive information” that is entered into the database will be deleted by GTIM. It is the user’s responsibility to contravene this clause, and the fact that “sensitive information” is disclosed by this means does not generate any kind of obligation for GTIM.

VII.- It is the responsibility of the Data Subject to ensure that the data provided to GTIM is truthful and complete, and they are responsible for communicating any modifications to GTIM so that the obligation to keep the information updated can be fulfilled.

VIII.- The duration of the handling of the Data Subject’s Personal Data will depend on the legal relationship established with GTIM, as well as the obligations required by current legislation and competent authorities. In all cases, the information will be stored only for a reasonable time for the fulfillment of legal obligations.

IX.- With this Privacy Notice, the Data Subjects are duly informed of the data collected from them and for what purposes, accepting the terms contained herein which were prepared in compliance with the Federal Law on Protection of Personal Data Held by Private Parties.

X.- GTIM reserves the right to modify this policy to adapt it to legislative or jurisprudential developments as well as industry practices. In such cases, changes introduced will be announced on this page with reasonable anticipation of their implementation.

XI.- This Privacy Notice, as well as GTIM’s general handling of personal information, is governed by the current and applicable legislation in the United Mexican States. Any controversy arising from its application must be settled before the competent courts of the city of Monterrey, Nuevo León, Mexico, and in accordance with current Mexican legislation.
